Leave for Appeal to CFA Granted for Leung Kwok Hung (Long Hair) in relation to the Legislative Council (Powers and Privileges) Ordinance FAMC 20/2020; Appeal from HCMA 520/2018

Mr. Leung Kwok Hung (aka Long Hair) was granted leave to appeal to the Court of Final Appeal against the Court of Appeal’s ruling that section 17(c) of the Legislative Council (Powers and Privileges) Ordinance (“LC(PP)O”) is applicable to members of the LegCo for conduct within LegCo proceedings. The leave application was heard by Hon Cheung CJ, Hon Ribeiro PJ, and Hon Fok PJ. Our firm instructed Lord Pannick QC, Ms. Margaret Ng, Mr Carter Chim and Mr Jason Lee to represent Mr. Leung in this application.

Mr. Leung was charged with the offence of contempt contrary to section 17(c) of the “LC(PP)O” for taking a document from a government official at a LegCo panel meeting on 15 November 2016. The Magistrate found that the offence of section 17(c) was inapplicable to the conduct of a LegCo member in LegCo proceedings. This decision was overturned at the Court of Appeal.

The substantive appeal hearing will be heard on 31 August 2021 by the Court of Final Appeal.
